The Obama administration said it would decide by mid-November whether to bring charges in federal court in the United States against the five detainees at Guantánamo Bay, Cuba, accused of involvement in the September 2001 terrorist attacks, according to government legal papers filed Wednesday. It did so as it moved to head off a sweeping challenge to the entire system of terrorism trials in specialized military tribunals, created by Congress three years ago. Filed in D.C. Circuit Court in the case of Bin Al-Shibh v. U.S. (docket 09-1238), the government brief is here. In January the government had already asked for a 120-delay, which was followed by another 120-day postponement.
